Terms of Service
These Terms of Service ("Terms") are an agreement between you and Dahlstrom Technologies LLC, a California limited liability company doing business as Plan Check Correct ("Plan Check Correct," "we," "us"), and govern your use of plancheckcorrect.com, the correction-letter tool, the Site Plan Creator and related features (the "Service"). By using the Service you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
1. What the Service is, and what it is not
The Service is drafting software. It helps you organize and respond to building department plan check comments, mark up plans, and draw site plans. It provides general information and drafts for you to review, edit and decide whether to use.
The Service does not provide licensed engineering, architectural, land surveying, or legal services, and using it does not create a professional relationship of any kind. Where a project requires a licensed professional (for example stamped calculations, structural design, or a boundary survey), you are responsible for hiring one.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service for a company, you confirm you are authorized to accept these Terms for it.
Accounts are optional. If you create one, you are responsible for keeping access to your email account secure, because sign-in links are sent there, and for activity under your account. Tell us promptly at office@solarpoolservicesinc.com if you believe your account has been used without permission.
3. Your content
- You own your content. Letters, plans, photos, drawings, text and other material you upload or create ("Your Content") remain yours.
- Permission to process it. You give us a limited, non-exclusive license to host, copy, transmit, process and display Your Content, and to send it to our service providers (including our AI provider), only as needed to provide, secure and support the Service for you. This license ends when Your Content is deleted from the Service, except for copies our providers keep under their own retention rules described in the Privacy Policy.
- Your permission to upload. You confirm you have the right to upload Your Content, including plans, letters and information about other people such as property owners, and that doing so does not violate anyone's rights, a confidentiality obligation, or the law.
- Output. As between you and us, you may use the responses, drawings and documents the Service produces for you ("Output") for your projects. Output may be similar to output produced for others.
4. AI-generated content
Parts of the Service use artificial intelligence. AI-generated explanations, code references, responses, checklists and suggestions can be inaccurate, incomplete or out of date, and may not reflect your jurisdiction's adopted codes or local amendments. You must review and verify all Output before relying on it or submitting it to any agency.
5. Site plans, measurements and imagery
Property lines, dimensions, setbacks, areas, aerial photos, address lookups, traced plans and drawings produced with the Service may be approximate. Aerial imagery can be offset, outdated or distorted, and address lookups can point to the wrong parcel. Site plans made with the Service are not surveys. Verify all measurements and property information against reliable sources such as recorded maps, surveys, deeds and field measurements before relying on them.
6. No guarantee of permit approval or code compliance
We do not guarantee that any plan, response or submittal prepared with the Service will be approved, will satisfy a plan reviewer, or complies with any code, ordinance, HOA rule or other requirement. Building departments make their own decisions. You remain responsible for your project and for meeting all applicable requirements.
7. Acceptable use
You agree not to:
- use the Service to break the law, infringe others' rights, or submit false or misleading documents to any agency;
- upload malware, or content you are not allowed to share;
- access, or try to access, other users' data or our systems without permission, or probe, scan or test their vulnerability;
- use the Service's AI or lookup features for purposes unrelated to the Service, scrape it, or send automated or excessive requests;
- interfere with, overload or disrupt the Service, or get around usage limits or security measures;
- copy, resell or reverse engineer the Service except as the law allows.
8. Our intellectual property
The Service, including its software, design, text and sample content, belongs to us or our licensors and is protected by law. We give you a limited, revocable, non-transferable right to use the Service under these Terms. Feedback you send may be used to improve the Service without obligation to you.
9. Third-party services
The Service relies on third parties, including Cloudflare (hosting), Anthropic (AI), public geocoding services, U.S. Geological Survey imagery, Google (fonts and forms) and open-source software. We are not responsible for third-party services, and their availability and accuracy may change.
10. Free beta; changes to the Service
The Service is currently offered free of charge as an early-access beta. We may change, add or remove features, impose usage limits, or stop offering the Service. We will try to give reasonable notice of significant changes.
The Service is currently free. If we introduce paid plans, we will show you their terms, including price, renewal, cancellation and refund terms, and ask you to agree to them before you are charged anything.
11. Your data, storage and termination
Your projects are stored in your own browser on your device unless you save them to an account, and you can delete them at any time. We are not responsible for loss of projects stored on your device, for example if you clear your browser data. Keep your own copies of anything important.
We may suspend or end your access if you violate these Terms or if needed to protect the Service or others. You may stop using the Service at any time. If you have an account, you can download a copy of your account data and delete your account at any time from your account page. Deleting your account deletes the projects and files saved to it, as described in the Privacy Policy. If we end the Service or close your account for reasons other than a violation of these Terms, we will try to give you a reasonable chance to download your saved projects first.
12. Disclaimers
To the extent permitted by law, the Service and all Output are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Some jurisdictions do not allow certain warranty disclaimers, so some of these may not apply to you.
13. Limitation of liability
To the extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, project delays, permit fees, rework costs or lost data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim or US $100. These limits do not apply to liability that cannot be limited by law, including for fraud, gross negligence, willful misconduct, or violations of law.
14. Indemnity
You agree to defend and indemnify us against third-party claims arising from Your Content or your violation of these Terms or the law, to the extent permitted by law.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing a claim, each party agrees to try to resolve the dispute informally by contacting the other for at least 30 days. Any dispute not resolved informally will be brought in the state or federal courts located in Orange County, California, and each party consents to their jurisdiction, except that either party may bring an eligible claim in small claims court.
16. Changes to these Terms
We may update these Terms. We will post the new version with a new date and version number. For material changes, we will give notice on the site and by email to account holders before they take effect, and where required we will ask you to accept the new Terms before you continue using the Service. Earlier versions are kept on file.
17. General
If any part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms and the Privacy Policy are the entire agreement about the Service.
18. Copyright complaints
We respect copyright, including the rights of architects and designers whose plans may be uploaded to the Service. If you believe material stored on the Service infringes your copyright, send a written notice to our designated copyright agent: Copyright Agent, Dahlstrom Technologies LLC, 47 Calle Mattis, San Clemente, CA 92673 · office@solarpoolservicesinc.com.
Your notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work you believe is infringed; (c) identification of the material you claim is infringing, with enough information for us to find it; (d) your name, address, telephone number and email; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and (f) a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
If we remove material in response to a notice, we will try to tell the user who uploaded it. That user may send a counter-notice to the same agent that includes: their physical or electronic signature; identification of the removed material and where it appeared before removal; a statement under penalty of perjury that they have a good-faith belief the material was removed by mistake or misidentification; their name, address and telephone number; and a statement that they consent to the jurisdiction of the federal district court for their address (or, if they are outside the United States, any judicial district in which we may be found) and will accept service of process from the person who sent the original notice. We may restore the material 10 to 14 business days after we receive a valid counter-notice, unless the person who sent the original notice tells us they have filed a court action.
In appropriate circumstances, we will close the accounts of users who repeatedly infringe others' copyrights.
